The order will be delivered to the address designated by the customer at the time of contracting, according to the chosen method.
The scope of delivery includes the following areas: Those countries or regions that appear in the data collection drop-down list. Countries belonging to the European Economic Area (EEA) continue to be added. For all other geographic areas outside the EEA, please contact My-Dune to evaluate the possibility/availability.
Our commitment to delivery times is 2 to 8 days maximum. For orders placed after 13:00 the delivery time will be extended by 24 hours. The deadlines described above are for products that are in stock, otherwise you will be informed by e-mail of the approximate preparation/shipping and delivery time or we will propose an equivalent substitute product, if possible.
Lead times for customized products are 3 to 6 weeks.
Delivery times may vary for reasons beyond the control of My-Dune, whether due to general and/or sectoral strikes, the calendar of national, provincial or local holidays, as well as atmospheric phenomena that prevent the normal development of the logistic activity of transport, in any of its modalities.
My-Dune reserves the right to vary the type of shipment and the carrier by which the shipment is made, regardless of what is stated on this website and provided that it does not involve a manifest prejudice to the customer. Any change/modification in the form, dates or transport company will be communicated to the customer by e-mail.
PRICES, EXPENSES AND TAXES
Prices for services available at www.my-dune.com are presented in Euros, unless otherwise indicated, and will remain in effect for the stated period, except in the case of typographical errors.
The final prices of all services, including features, offers, promotions and discounts, are detailed in the description of each of the services offered on the website.
– VAT is included in the price of the products.
– The VAT rate is 21%.
– Shipping costs: Shipping costs will be detailed in the purchase process and will depend on the place of delivery.
– Other additional costs: Shipping costs to areas outside the European Customs Union do not include import costs (customs duties), which will be paid at destination by the recipient of the goods.
Product prices are subject to change at any time. In this case, the price to be applied will be the price in effect on the date the order was placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before the customer formalizes his acceptance.

WARRANTY
The products purchased through www.my-dune.com are original, are not manipulated or modified in accordance with the legally established terms and enjoy a warranty period of 2 years from the date of delivery, which cover possible manufacturing defects of the product, as well as any damage caused during that period, provided that such damage is not attributable to the consumer / user, as well as those products that do not correspond to the order or purchase made.
All interventions/repairs carried out within the warranty period do not imply an extension of the initial 2-year term.
My-Dune guarantees that its e-commerce platform is technically prepared for the sale of products and/or services.
My-Dune makes every effort to ensure that the information (images and descriptions) appearing on the website are correct and reflect the qualities of the product, so the texts accompanying the images are the reproduction of information contained in the packaging, instructions for use or indicated by the manufacturer. Differences between images and products may be minimal and do not affect the essential characteristics of the products. The color of the products shown in the online store may differ from the actual color of the product.
In the event that the purchased product has any defect, deterioration, or imperfection not related to misuse, the consumer must notify the customer service of My-Dune, as soon as he becomes aware of it and always within the legally established period.
To make use of the warranty it is essential to present the invoice/tique of purchase.
Unless there is evidence to the contrary, delivery shall be deemed to have been made on the day shown on the invoice or purchase receipt, or on the corresponding delivery note if this is later.
In cases in which the use of the warranty is justified, the damaged product will be replaced or returned, according to the legally established terms. DREAM Fontanilles will be responsible for any expenses incurred as a result of the return of the product.
For products of a durable nature, the consumer shall be entitled to an adequate technical service and the existence of spare parts for a minimum of 5 years from the date on which the product ceases to be manufactured, without being able to increase the price of the spare parts when applying them in repairs.

To avoid problems with the installation or operation of the purchased product, make sure that you have followed the installation and operating instructions contained in the user manuals.
If, even so, the purchased product does not work properly, you should immediately contact the manufacturer’s customer service and technical assistance or, if applicable, the representative or distributor.
LIABILITY AND DISCLAIMER OF LIABILITY
The consumer and user has the right to the repair of the product, its replacement, price reduction or termination of the contract, according to the provisions of Chapter II Tit. IV Book II of the General Law for the Defense of Consumers and Users.
If the product is not in conformity with the contract, the consumer may choose between repair or replacement of the product, both free of charge for the consumer, which will be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.
If, once the repair has been completed and the product has been delivered, it is still not in conformity with the contract, the consumer may demand its replacement, a price reduction or the termination of the contract.
CUSTOMER SERVICE AND COMPLAINTS
To file any complaint or claim with My-Dune, the customer should contact customer service. The necessary information will be made available to users for this purpose.
Pursuant to the EU Consumer Online Dispute Resolution rules and in accordance with Article 14.1 of Regulation (EU) 524/2013, the customer is informed that the European Commission provides an online dispute resolution platform, accessible at the following link: http://ec.europa.eu/consumers/odr/.
FORCE MAJEURE
My-Dune shall not be liable for any failure to perform or delay in performing any of our obligations under a contract where such failure or delay is due to events beyond our reasonable control (“Force Majeure”).
Force Majeure shall mean any act, event, failure to exercise, omission or accident beyond our reasonable control, including, but not limited to:
– Strikes, lockouts or other industrial action.
– Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or undeclared) or threat or preparation for war.
– Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
– Inability to use trains, boats, airplanes, motorized transport or other means of transportation, public or private.
– Inability to use public or private telecommunications systems.
– Acts, decrees, legislation, regulations or restrictions of any government or authority.
Our obligations under the contracts will be suspended during the period in which the Force Majeure continues, and we will have an extension of time to fulfill such obligations for a period of time equal to the duration of the Force Majeure situation. We will use all reasonable means to end the Force Majeure situation or to find a solution that allows us to fulfill our contractual obligations despite the Force Majeure.
LIMITATION OF LIABILITY
My-Dune is not responsible for any damages that may result from:
– Errors or omissions in the contents, lack of availability of the portal or the transmission of viruses or malicious or harmful programs in the contents, despite having taken all the necessary technological measures to prevent it.
– Damages that may arise from the improper or inappropriate use of the website by users.
– The operability or problems in the e-mail address provided by the user to send the confirmation of the purchase.
In no event shall My-Dune be liable for any loss or damage arising from improper use of our products by users.
FINAL PROVISIONS
My-Dune reserves the right to modify the conditions set forth herein at any time, being duly published as they appear here. The validity of these conditions will depend on their exposure and will be in force until they are modified by other duly published conditions.
SAFEGUARD CLAUSE
If any of the clauses included in these general conditions were to be declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall only affect such provision or the part thereof that is null or ineffective, the rest of the general conditions subsisting in all other respects, and such provision being considered totally or partially as not included.
APPLICABLE LAW
The present conditions are subject to the Spanish legislation in force.
In case of any conflict or discrepancy in the interpretation or application of these Terms and Conditions or the content of the website in general, My-Dune and the user agree to submit, expressly waiving any other jurisdiction that may apply, to the jurisdiction of the Courts and Tribunals of the user’s domicile. If the user resides outside Spain, My-Dune and the user agree, also expressly waiving any other jurisdiction, to submit to the jurisdiction of the Courts and Tribunals of Girona.
The following regulations shall apply:
– Law 7/1998, of April 13, 1998, on General Contracting Conditions.
– Royal Legislative Decree 1/2007, of November 16, 2007, approving the revised text of the General Law for the Defense of Consumers and Users.
– Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, and the General Data Protection Regulation (GDPR).
